Florida Hemp Laws: What You Can Legally Buy Online
Hemp laws in Florida — and across the US — have changed significantly over the past several years. If you're shopping for hemp products online and want to know what's legal, here's a straightforward summary of where things stand.
The 2018 Farm Bill: Federal Foundation
The 2018 Agriculture Improvement Act (commonly called the Farm Bill) federally legalized hemp and hemp-derived products containing less than 0.3% Delta 9 THC by dry weight. This is the law that made products like CBD, Delta 8, THCA, and THC-P federally compliant when derived from hemp.
Florida's Hemp Program
Florida aligned with the federal Farm Bill and established its own hemp program under the Florida Department of Agriculture and Consumer Services (FDACS). Hemp-derived products sold in Florida must:
- Be derived from hemp (not marijuana)
- Contain no more than 0.3% Delta 9 THC by dry weight
- Be accompanied by a certificate of analysis (COA) from an accredited lab
Under these rules, CBD, Delta 8, Delta 9 (hemp-derived, under the 0.3% limit), THCA, THC-P, HHC, and other hemp cannabinoids are legal to buy and possess in Florida as long as the products meet the above requirements.
What Changed Recently: SB 1698 (2024)
In 2024, Florida passed SB 1698, which placed new restrictions on hemp products — specifically around marketing, packaging, and sales to minors. Key points:
- Hemp products cannot be marketed to minors or use cartoon characters/imagery appealing to children
- Products must be sold in child-resistant packaging
- Hemp retailers must register with FDACS
- Products must have a scannable QR code linking to the COA
These rules apply to licensed retailers in Florida. Online purchases from compliant retailers that ship to Florida are governed primarily by federal law.
What Can You Order Online and Ship to Florida?
Florida residents can legally order and receive the following hemp-derived products shipped to their door:
- CBD — gummies, tinctures, capsules, topicals, vapes
- Delta 8 THC — gummies, vape cartridges, flower, tinctures
- THCA — flower, pre-rolls, concentrates
- THC-P — vapes, gummies, concentrates

What's Not Legal in Florida
Marijuana — cannabis products with more than 0.3% Delta 9 THC — remains illegal for recreational use in Florida. Medical marijuana is legal only for registered patients through licensed dispensaries.
